These Terms & Conditions govern all courier, transportation, warehouse, freight forwarding, import, export, customs clearance, logistics, and delivery services provided by OCEAN EXPRESS PVT LTD. By handing over any shipment, cargo, document, or payment to the Company, the sender/customer fully agrees to all terms, conditions, liability limitations, operational procedures, and legal clauses stated below.
AMENDMENT OF TERMS
OCEAN EXPRESS PVT LTD reserves the right to amend, revise, modify, or update these Terms & Conditions at any time without prior notice.
CUSTOMER ACKNOWLEDGEMENT
By handing over goods or using Company services, the Customer confirms that:
• They have read and understood these Terms & Conditions
• Shipment details are accurate
• Goods are properly packed
• Goods comply with Sri Lankan law
• They accept all liability limitations
• They authorize OCEAN EXPRESS PVT LTD to transport, clear, store, and deliver shipments accordingly

DEFINITIONS
“Company”, “Carrier”, or “OCEAN EXPRESS” means OCEAN EXPRESS PVT LTD, including its employees, directors, agents, warehouse staff, customs coordinators, subcontractors, drivers, franchisees, and representatives.
“Customer”, “Client”, or “Sender” means the person, company, business, or organization handing over the shipment or requesting services.
“Receiver” means the consignee, recipient, importer, exporter, or authorized person accepting delivery.
“Shipment” means parcels, cartons, cargo, pallets, packages, goods, freight, or documents transported under one booking, invoice, or waybill.
“Waybill” means the transport receipt, invoice, airway bill, shipping document, booking confirmation, manifest, electronic record, or courier document issued by the Company.
SERVICES COVERED
The Company provides services including but not limited to:
• Domestic courier services
• International courier services
• Import services
• Export services
• Customs clearance
• Freight forwarding
• Cargo handling
• Warehousing
• Delivery services
• COD services
• Transportation and logistics coordination
All services are subject to these Terms & Conditions.
ACCEPTANCE OF TERMS
By handing over any shipment or using Company services:
• The Customer confirms acceptance of all Terms & Conditions.
• The Customer confirms shipment information is accurate.
• The Customer accepts all liability limitations.
• Electronic records and digital confirmations shall be legally valid evidence.
These Terms apply whether accepted physically, electronically, verbally, or through shipment handover.
DECLARATION OF GOODS
The Customer must accurately declare:
• Full contents of shipment
• Correct rupee value
• Weight and dimensions
• Quantity of goods
• Fragile, liquid, dangerous, or sensitive items
• Customs declarations where applicable
The Company reserves the right to:
• Open
• Scan
• Inspect
• X-ray
• Hold
any shipment without prior notice for operational, customs, security, or legal purposes.
False declarations, undervaluation, concealment, or misleading information may result in:
• Refusal of shipment
• Customs penalties
• Delivery cancellation
• Delay
• Confiscation
• Reporting to authorities
• Legal action
PAYMENTS
Payments shall only be considered valid if made to:
• Official bank accounts of OCEAN EXPRESS PVT LTD
• Cheques issued in the name of OCEAN EXPRESS PVT LTD
• Official online payment channels authorized by OCEAN EXPRESS PVT LTD
The Company shall not be responsible for payments made:
• To personal accounts
• To unauthorized third parties
• To agents without written authorization
• Through unofficial payment methods
Customers are responsible for verifying official payment details before making any payment.
INSURANCE REQUIREMENT
Goods valued above Rs. 5,000 must obtain insurance by paying 2.5% of the declared shipment value.
Standard courier or cargo charges do not include:
• Transit insurance
• Compensation insurance
• Damage protection
• Theft coverage
Failure to insure high-value goods means transportation occurs entirely at the Customer’s risk.
LIMITATION OF LIABILITY
If a shipment is proven beyond reasonable doubt to be lost while under Company custody, the maximum compensation payable shall not exceed Rs. 5,000 per shipment or per waybill regardless of declared value.
The Company is responsible for parcels for a maximum period of 14 days from the delivery date or scheduled delivery date.
No claims or liabilities shall be accepted after 14 days.
The Company shall not be liable for:
• Loss of business
• Loss of profits
• Delay-related losses
• Consequential damages
• Emotional or sentimental value
• Customs delays
• Port delays
• Airline delays
• Shipping line delays
No compensation shall be paid for damages caused by:
• Floods
• Natural disasters
• Fires
• Vehicle accidents
• Civil unrest
• Riots
• Terrorism
• Weather conditions
• Customs inspections
• Government restrictions
• Strikes
• Port congestion
• Mechanical failures
• Force majeure events
CUSTOMS & IMPORT / EXPORT CONDITIONS
The Customer is fully responsible for:
• Customs duties
• Taxes
• Import/export permits
• Licenses
• Regulatory approvals
• Customs documentation accuracy
The Company acts only as a logistics and customs coordination service provider and shall not be liable for:
• Customs seizures
• Government penalties
• Import/export restrictions
• Delays caused by customs authorities
• Incorrect customer documentation
Any customs penalties, storage fees, demurrage charges, or legal costs resulting from incorrect declarations shall be borne entirely by the Customer.
FRAGILE ITEMS & PACKAGING
Fragile items are transported entirely at the Customer’s risk.
The Company accepts no responsibility for damages to:
• Glassware
• Electronics
• TVs
• Monitors
• Liquid items
• Ceramics
• Antiques
• Artwork
• Sensitive equipment
Proper packaging must follow the “Box-in-a-Box” method:
• Wrap items using 3–5 layers of bubble wrap
• Fill empty spaces with packing material
• Prevent movement inside the package
• Use reinforced H-taping
The Company may reject unsafe or improperly packed shipments.
DELIVERY CONDITIONS
Delivery schedules are estimates only and are not guaranteed.
Due to road and transport limitations:
• Wewa and remote area deliveries may be delayed or unavailable.
• Certain deliveries may require collection from warehouses or branches.
The Company shall not be liable for delays caused by:
• Traffic
• Road closures
• Weather
• Government restrictions
• Customs inspections
• Port congestion
• Airline delays
• Operational interruptions
Electronic signatures, photographs, GPS records, OTP confirmations, SMS confirmations, and digital delivery logs shall be accepted as valid proof of delivery.
DELIVERY ATTEMPTS & RETURNS
The Company will attempt delivery a maximum of two times.
Additional charges may apply if:
• Receiver is unavailable
• Address is incorrect
• Contact number is unreachable
• Delivery is refused
Undeliverable shipments may be:
• Returned to sender
• Stored
• Held at warehouse
• Disposed of after 30 days
All return and storage charges shall be borne by the Customer.
PROHIBITED ITEMS
The Company will not knowingly transport:
• Cash
• Currency
• Jewellery
• Precious metals
• Firearms
• Ammunition
• Explosives
• Illegal drugs
• Hazardous chemicals
• Dangerous goods prohibited by Sri Lankan law
• Illegal products
If accepted by mistake, the Company bears no liability whatsoever.
RIGHT TO REJECT SHIPMENTS
The Company reserves the absolute right to:
• Reject shipments
• Hold parcels
• Refuse transportation
• Refuse delivery
• Suspend customer accounts
• Cancel services
without assigning any reason.
CLAIMS & COMPLAINTS
Complaints regarding:
• Loss
• Damage
• Delay
• Wrong delivery
• Shortage
must be submitted in writing immediately.
Claims without:
• Waybill copy
• Payment proof
• Supporting evidence
shall not be entertained.
Transportation charges must be fully settled before any claim review.
LEGAL & ARBITRATION
All disputes shall be governed under the laws of Sri Lanka.
If legal action becomes necessary:
• Final coordination shall be directed through Company warehouse management and authorized legal representatives.
• Arbitration or legal proceedings shall fall under the jurisdiction selected by OCEAN EXPRESS PVT LTD.
• Courts of Colombo, Sri Lanka shall have exclusive jurisdiction.
The Company reserves the right to recover all legal costs from the Customer.
NO MODIFICATION
No employee, driver, agent, representative, or subcontractor has authority to modify or waive these Terms unless approved in writing by Company management.
